This Digital Millennium Copyright Act (“DMCA”) Policy applies to the soulatools.com website (“Website” or “Service”) and its associated services (“Services”). This Policy explains how we (“Operator”, “we”, “our” or “us”) respond to copyright infringement claims and how you (“you” or “your”) can submit a copyright complaint.
We respect intellectual property rights and expect our users to do the same. We operate in compliance with the Digital Millennium Copyright Act of 1998 (DMCA).
What to Consider Before Submitting a Copyright Complaint
Please ensure your claim qualifies as actual infringement and not fair use. Fair use allows limited use of copyrighted material for purposes such as commentary, criticism, news reporting, education, and research without permission.
If you are unsure whether material qualifies as infringement, consult a legal expert before filing. DMCA requires your personal details; if concerned about privacy, you may consider hiring a third-party agent to act on your behalf.
Notifications of Infringement
If you believe that any content made available through our Website infringes your copyright, you may submit a formal DMCA notice to our Designated Copyright Agent. The notice must substantially comply with the requirements set forth in 17 U.S.C. § 512(c)(3).
Elements of a Formal DMCA Notice:
To ensure your notice is legally valid and to expedite its review, it must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., the specific URL(s)).
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
We reserve the right to disregard any notice that does not contain all of the elements listed above.
Our Response to Infringement Notices
Upon receipt of a valid and complete DMCA notice, we will take whatever action we deem appropriate, which may include removing or restricting access to the allegedly infringing content. We will also aim to notify the affected user about the removal or restriction, if applicable, to allow them to file a counter-notification.
Counter-Notification
If an affected user believes that their content was removed or access was disabled as a result of mistake or misidentification, they may file a counter-notification. The counter-notification must substantially comply with the requirements of 17 U.S.C. § 512(g)(3).
Upon receipt of a valid counter-notification, we may reinstate the content in question after 10 to 14 business days, provided we have not received notice from the complaining copyright owner that a court action has been filed seeking a court order to restrain the user from engaging in infringing activity.
